If I Brake Suddenly To Avoid Hitting An Animal In The Road & The Car Behind Hits Mine, Will Insurance Cover It?

just occurred to me today as a couple of times today there was a bird in the road & yes i know some people might brake for a cat or dog but maybe not for a bird. No smart comments, i just wouldnt want to hit ANY living person or animal.

    If a car behind you hits you for any reason whatsoever it is the other drivers fault as they would have been driving too close to deal with what could happen in front of them. As it is the other drivers fault then their insurance would be liable.
    If you brake or swerve to avoid an animal or bird and cause damage or even death to another person you would be prosecuted.
    I suggest that you make sure that you are not going to cause anyone problems before you make the manoeuvre or brake as animals are not as important as people in such situations.
    Hundreds of birds are killed on roads everyday and you saving one at risk to you and those around you would be foolish – i am sure you will agree.

    As other answers, it’s the fault of the vehicle behind.
    However, don’t be too sanctimonious about this: If it’s a choice between squashing a bird & having a 44 ton lorry squash you & your children, regardless of whether they’re travelling too close behind you, then there’s only one option.
    You could also question the possibility of injuries to people in any following car if they weren’t wearing seatbelts, or had a child standing up between the back seats (as some people still unbelievably do!) – I think I’d rather flatten a bird than have the recurring vision of a child being crushed to death against my back window after being thrown through a windscreen…
    A lot to think about morally – good question.

    if you are just driving along and brake then the car behind ought to be able to stop, if of course he isn’t on the phone! eg You might have stopped for a small child fallen off a bicycle
    if you have just overtaken a 40-ton truck and pull too close in front then brake, the claim will be for your inheritor to sort out, not you.
    I suggest that ordinary small birds are quite expert at seeing cars coming and flying out of the way, a flash of your headlights is sometimes enough to move them. Pheasants don’t notice though.

    The guy behind is at fault. IF he is insured you should be OK. More such accidents happen following someone who knows where the speed cameras are and slams on the brakes, you on the other hand not knowing the area have to be sharp on the brakes.
    The government doesn’t give a damn how much fuel/energy is being wasted braking when coming to a lower speed limit!

    This won’t go down too well with someone but if the car behind drives too close up I might slam on the brakes even if there is no animal.
    If they hit me they fix the car, period.
    You may also brake as hard as you will and if I am such a fool to crash into you, it would be my fault.

    Yes..if you get hit by another car from behind its never your fault.If you brake hard for any reason and get hit from behind its the driver behind who is always at fault…the law sees it as driving without due care and attention..thats what happened to me..

    If you’re asking from the UK then the answer is whenever someone hits you from behind it’s their fault – because if they’d kept a sensible distance they would not have hit you after breaking. So….. their insurance should cover your damage.

    the car that hit you would be at fault for driving withouth due care and attention, as it drove into you, but only if you put your hazard warning lights ON

    They would be at fault still.
    If they would have hit you for any reason, they would have been deemed to be driving to close.
