If A Friend Is Driving Your Car And Wrecks It, Can They File It On Their Insurance?

I own two vehicles. They are on separate insurance policies (different companies). I get a friend to follow me in the other car to transport them to a separate location. I get in front of him, and a cat runs out in front of me. I slam on breaks, and he runs into the back of me. I file the claim on insurance of the car I am driving. This insurance company then tries to seek subrogation from the insurance company from the car my friend was driving. The complicated part is that I own both cars and my name is on both policies…I can’t sue myself……can the friend driving my other car claim the wreck on his own personal insurance so some of the damages could be recovered???

    No, since insurance goes with cars, not drivers, anyone with permission to drive your car is also using your insurance policy. And as you said, you can’t collect from yourself. If you have collision coverage you could make the claim there, less your deductible amount.
    And why are you using two different companies instead of one and getting the multiple car discount? You are paying way too much that way.

    if you were hit from behind, it would be the driver’s fault that hit you. Report the accident to your insurance company and let them sort it out. Ultimately, your driver would need to compensate you for the accident. Any time someone is hit from behind, it is the other car’s fault for following too closely.

    Why would he, you gave them permissive use to drive your vehicle. Insurance follows the vehicle not the driver.

    NO. it is your car it is under your insurance hence they cant do it

    Probably not because the person was driving the vehicle at your request. They were on a mission for the owner. If your friend had asked to borrow your vehicle for their own purpose and had an accident the correct thing to do would be to file under the driver’s insurance first and whatever that did not cover would be the owner’s responsibility. Note, the previous statement may vary in some states due to insurance laws. I believe in all states however this would be filed under your policy. Just a note also, the insurance company is not suing you — they are collecting reimbursement from the other insurance company. This can happen even if your name is on both policies. Good luck!
