Health Insurance Company Falsely Declared Me As Pre-existing Condition. What To Do?

Recently I had strangulated hernia surgery. I was having extreme stomach pain and went to ER. In ER the cat scan revealed strangulated hernia and i was taken in ambulance to hospital for immediate surgery. I was insured that time.
The surgery was done. After that i still experienced stomach pains, and the gastro-enterologist suggested i get an endoscopy test done.
I got endoscopy done by the gastro-enterologist and a diagnosis of gastritis was revealed by the endoscopy.
The health insurance company sent me 2 letters. First letter requested i answer several questions in regard to the hernia surgery — like did any doctor ever before say i have hernia prior to my coverage, what medications i took from 2008 to 2009 and for what conditions and how much strength, to give name of previous insurance companies, etc etc.
The second letter said —
PRE-EXISTING CONDITION.
Then the hospital sent me letters saying that health insurance has refused to pay any bill and that now I am responsible for payment. They said i can pay in installment and that the first installment would be $3500 which I should pay out of pocket.
However, i seriously was never ever diagnosed of hernia or gastritis ever before. It came as a total surprise and i just can’t imagine how they made the pre-existing decision. I got my coverage in january 2008.
How can i be having strangulated hernia and gastritis in 2007 or before when there is no proof? I made several phone calls to the health insurance company, and they said the pre-existing condition decision is final.
Who should i complain to now?

    This is the exact thing Obama is trying to eliminate. Under health care reform NO preexisting condition will be used against anyone by these insurance company vultures.

    Call your State Insurance Commission, or whoever is in charge of licensing insurance companies/agents in your state. Tell them the situation. They are usually pretty good about threatening these outfits if it’s legally possible. I’m not saying it will happen, but your claim may suddenly get “approved”.

    What did you write in your questionaire? Do you have a copy of it? You may have to file a complaint with the State and possible consult an attorney and file a lawsuit. This is just another reason Obama’s health plan is a good idea and should get full support.

    I’ve worked with medical insurance for the past 40 years,
    and one of two things are true here:
    Either you have signed up with some obscure scam insurance company, OR
    You are lying blatently.
    Insurance companies, upon you being enrolled and accepted, present you with a coverage booklet and the equivelance of a contract that states what will and will not be covered. The only way a reputable insurance company would have done this to you, is if you are found to have AIDS, stomach cancer, or something quite serious that would cost the company millions upon millions of dollars -
    In this case, they have EVERY RIGHT to send you a form requesting information, because if you had already gotten notice from another facility that you have, say, Aids, and you were at the time UNCOVERED, you might sign onto an insurance company with the full knowledge that you were handing them a multi-million dollar responsibility to pay.
    People do this all the time; they have no insurance until they realize they have a serious ailment, and then they attempt to defraud others by signing onto an insurance policy. This burdens all the people who are on that insurance plan, with higher premiums because they would have to pay your expensive bills. The insurance companies are only trying to protect the rest of us from that burden of higher premiums thanks to your defrauding the system. I thank them for that.
    No insurance company is just going to not pay your tummy tests out of the blue unless they suspect something is up;
    HOW LONG HAVE YOU HAD THIS POLICY BEFORE THIS HAPPENED? If you had the policy for under a month, or a few months, that would raise the red flag.
    A more likely scenario:
    You are lying about this entire thing in an attempt to help your messiah demonize insurance companies. Still, over 85% of American citizens are happy with their present insurance plans. I’ve had mine for 42 years and have never once been questioned about a pre-existing condition.

    and the bigger the company the greater the challenge
    in Michigan we have *call on Sam* for Sam Berstein
    but in your area I am sure there is good legal advisers to show you your
